This isn’t going to be Michael Dell Babinski’s happiest birthday.
After an early morning standoff Tuesday in Wallace, Idaho, Babinski was taken into custody for the second time in three days and returned to the Missoula County jail.
He was there Saturday after allegedly threatening to “take down” the Hilton Garden Inn. But he posted bond on $50,000 Sunday, and then skipped out on a scheduled court hearing Monday. Bounty hunters tracked him down in Wallace Monday night.
On Tuesday afternoon, a defiant Babinski told Missoula County Justice of the Peace John Odlin that he’d had to flee Spokane “because the police attacked me and tried to kill me.”
And, he told Odlin that Wednesday would be his 43rd birthday.
“Happy birthday to me,” he said. Odlin gave him a $100,000 bail.
Kelli Martin, owner of Chase Investigations of Coeur d’Alene, Idaho, said that during Monday night’s standoff at the Wallace Inn, Babinksi raved about bombs and the federal Homeland Security Department. He was taken into custody at around 2 a.m., she said.
Martin described the trip back to Missoula as “the two-hour drive from hell.”
Babinski attracted the attention of Missoula police on Saturday when the Hilton Garden Inn sought help removing a man described as bearded, wearing camouflage pants, a T-shirt and a black coat, according to charging documents filed by Deputy Missoula County Attorney Andrew Paul. The man had a large dog with him, police said.
When police stopped Babinksi and patted him down, they found several knives on lanyards around his neck, a can of pepper spray, a stun gun, a .40-caliber semiautomatic handgun and a loaded magazine for a .40-caliber pistol, according to Paul’s affidavit.
“Are you sure it was a 40-cal?” Babinski asked Tuesday when Odlin detailed the allegations against him. “Shh!” public defender Russell LaFontaine warned him.
“Your honor, I’d like to represent myself if my attorney won’t speak for me,” Babinski said.
“Sir, I’d recommend you exercise your right to remain silent,” Odlin replied.
Deputy County Attorney Suzy Boylan told Odlin that the high bail was necessary “because the offenses as charged are worrisome for community safety.”
Hilton employees told police they kicked Babinski out on Thursday for having a dog, and that he returned Friday, according to Paul’s affidavit. But when asked Saturday to leave, Babinski “threatened to ‘take down’ the Hilton Garden Inn,” the affidavit said.
Officers who searched Babinski at the Missoula County jail Saturday found eight hydrocodone tablets and 7 1/2 lorazepam tablets, it said. A records check showed he had four restraining orders in Spokane County, Wash., and Shoshone County, Idaho, according to the affidavit. Two of those orders prohibit him from possessing firearms, it said.
On Tuesday, Odlin said that if Babinski manages to post bond again, he must keep away from the Hilton Garden Inn, wear a monitoring unit, and cannot have weapons.
Babinski is charged with criminal possession of dangerous drugs – opiates – and criminal possession of dangerous drugs, both felonies, as well as misdemeanor charges of criminal trespass and carrying concealed weapons.
The drug charges carry maximum penalties of five years in prison and a $50,000 fine.
